Lira district denies receiving Shs 600m Akii-Bua stadium funds

Lira district local government has denied receipt of Shs 665 million to construct Akii-Bua stadium. Lira chief administrative officer Mark Tivu said that the district only received about Shs 300 million which was meant to execute preliminary works on Akii Bua stadium.

Tivu says that the money was used for bush clearing of the 12-acre site, which involved uprooting trees and levelling of the land, opening boundaries, opening access roads, draining the swamp, construction of a pit latrine and the 200-seater pavilion that exists on the site today.
He added that a huge part of the money was used to compensate residents who had been occupying the land where the new stadium is being built. According to Tivu, no money was lost and all the received funds can be accounted for.
 
The explanation comes a day after the arrest of Lamex Omara, the commissioner physical education under the Education and Sports ministry over misallocation of Shs 665 million  meant for the construction of the Akii-Bua stadium.

Omara had appeared before the MPs with a team of officials from the ministry of Education and the National Council of Sports to responds to complaints from legislators from Lango region about the alleged mismanagement of funds allocated for the construction of the stadium.

Commissioner Omara defended himself, saying Lira district local government which did the work, should be held accountable. But Tivu trashed the claim, saying they did what they did within the available funds. 

Alex Oremo Alot, the Lira district LCV chairperson maintained there was value for money in the project which has been described shoddily constructed. Dickens Okello, a resident of Erute village where the stadium is being constructed urged for proper investigations to ascertain possible connivance between Lira district local government and the ministry of Education and Sports.
 
Okello says there was no value for money so far on the project. In 2008, President Museveni pledged to build a modern stadium in memory of the late John Akii-Bua, Uganda's first Olympic gold medalist.

Denied pension, Serubyale endures hunger for 38 years

At 85, James Green Serubyale, struggles with absolute poverty, unanswered requests for pension pay cheques and unfinished plans.

Before he slipped into poverty, Serubyale served Buganda government as an assistant superintendent of works in the '50s before briefly joining the post-independence central government of Uganda. He was retired in 1967 and has been fighting for his pension for 38 years, writes Yudaya Nangonzi.

He shakily walks towards our reception with the assistance of a male friend. Clad in full scout uniform patched with various badges, scarf and cap that partly covers his greyish hair, Serubyale is dapper and excited. He opens his old briefcase as I gaze at a grimy identity card fixed with a soft pin on blue ribbon slung around his neck.

"We converged in 2013 to receive music teachers from America. They gave me this ID and I treasure it," Serubyale recalls with pride as he shares a green file full of original and photocopied documents.

"All those who grabbed my land and that of my wife, curriculum vitae (CV), appointment letter and evidence that my pension was paid but they stopped [remitting money] on December 31, 1980 without clear explanations," Serubyale says.

From first impressions, one may despise him until you peruse through his rich CV. Serubyale is a civil engineer, an architect, deacon, evangelist, master guide, musician, artist, mathematician, quantity surveyor and herbalist. He is also an official guardian of the children of the late Kabaka Muteesa II.

PENSION BATTLES

Having studied in Uganda's top schools then and stayed in the UK between 1957 and 1963, Serubyale is a confident man. He expresses himself very well in both English and Luganda.

He starts with a quote: "You can delegate authority but you cannot delegate responsibility."

"President Museveni should come to my rescue. Let him order his people to pay me and as well find me genuine lawyers to fight my land problems," says the King's College Budo alumnus (1949-1951).

After serving in various construction companies and the Buganda government as an engineer, Serubyale was on January 7, 1957 appointed acting assistant superintendent of works in the then Mengo government. According to the letter signed by E.H Kamanyi, Serubyale's starting salary would be Pound Sterling 588 per annum in scale E1, C6-C5 (£ 408 x  £ 18 - £ 516 x £ 24 - £ 684).

"You will abide by the terms and conditions (of 1956) set by Kabaka's government for chiefs and other kingdom employees. You are entitled to all benefits for chiefs and other employees such as pension and others," reads Kamanyi's letter.

After nine years, in a letter dated March 24, 1965, he was appointed assistant engineer-in-chief of the kingdom, another pensionable office, under salary scale AP (£ 1,731 to £ 1,791).

The following year, Prime Minister Apollo Milton Obote, the executive head of the central government, ordered army commander Idi Amin to attack the Lubiri. Serubyale says during this political turmoil, Obote ordered all engineers in the kingdom to join the central government. While his colleagues adhered, Serubyale declined.

"I was too angry because Obote did not respect my king. Obote also got angry with me," he says. "Since I was a permanent and pensionable civil servant, Obote respected that and instead sent me a letter."

He no longer has this letter, though. Serubyale says he suffered two house break-ins by soldiers who stole his property and burnt some of his documents including letters of appointment, promotions, salary scales and retirement.  He, however, remembers that the letter went something like this: "I have been directed by the president of the republic of Uganda that you have been retired in public interest with effect from August 1, 1967. You will be given all your retiring benefits including pension."

Starting August 1, 1967, government started paying his monthly pension until December 31,1980. According to his records, Masaka district administration, which was the paying authority, stopped remitting money on December 31, 1980.  He has written countless letters to the authorities, all in vain.

With support from some officials at the district, Serubyale has compiled a list of particulars for at least 124 cheques, including their numbers, dates and years credited to his bank account between December 11, 1967 and May 7, 1980. But when on June 11, 1996, Serubyale visited the Masaka office, he was told his name was not on the list of pensioners.

"I thought the absence of records in their office was an obstacle and I again on August 9, 2005 carried with me a big file containing overwhelming evidence to clear any doubt that I am a pensioner," he says.

The officials at the district seemed unconvinced even when he handed over copies of his documents. He cites one Ms Kafeero, a senior personnel officer, who asked him to present his letter of appointment. But the two house break-ins in 1982 and 1994 along Salama road and in Bbunga, respectively, had robbed him of those documents.

The thefts were recorded at Katwe police station under reference number CRB 861/82, and Kabalagala police station reference number SD 02/18/03/94.

Serubyale says Kafeero was "adamant and elusive", which forced him to engage the services of lawyers. As luck would have it, seasoned lawyer Peter Mulira was the counsel in the matter. When he was at Budo, Mulira was in Budo Junior. One of Mulira's teachers was Serubyale's brother, Daniel Kesi Kabugo.

"Mulira was too delighted to help without charging me a single cent. He wrote a letter to Masaka [on May 8, 2006] demanding that my issues be handled or he sues them," he recalls.

Unfortunately, Kafeero informed him that the first file got lost.

"Ms Kafeero said she would go through the file and inform me later. To-date, I have not heard from Kafeero or any other officer from Masaka district headquarters," Serubyale says.

"She made me move several times until I ran out of transport [money]. I am an old man and I don't think she will even respect and help me trace that big file again."

His efforts to engage the ministry of Public Service did not bear any fruit either as he was referred back to Masaka.

"I don't have money to bribe officers to help sort my issues. If President Museveni can order his people, maybe they will listen," he says.

Serubyale is forlorn, having lost his "greatest companion" and wife, Nnalinya Victoria Kamuwanda Mpologoma on September 13, 1978. She succumbed to diabetes and hypertension at Lubaga hospital. They did not have children together due to Mpologoma's poor health.

"She really tried but failed to carry any pregnancy. With her health, doctors advised that I would lose her, the baby or both," Serubyale says in a low tone.

Stopping his pension makes his loss doubly unbearable. The acting commissioner for compensation in the ministry of Public Service, Victor Bua, told I recently that Serubyale's matter can only be addressed if he presents original appointment, confirmation and retirement letters.

"We need to establish circumstances under which he was retired, his salary scale and terms and conditions of the job, among others, before we write to the appropriate office to start processing his pension if he deserves it," Bua said.

Land disputes

As fate would have it, Serubyale is fighting on a second front. He accuses Kabaka Mutebi's sister, Nnalinya Sarah Kagere, of grabbing his late wife's property. Due to his undying love for the kingdom, Serubyale says he has chosen not to sue but engaged Bernard Mutyaba of Kinobe, Mutyaba and Turinawe (KMT) Advocates.

On February 17, 2014, KMT wrote to Kagere demanding that she renounces administration of Mpologoma's estate.

"It is the client's considered opinion that the law on succession entitles the legally married husband of the deceased to 99 per cent share of the estate. We believe you will find the proposals herein tenable and we, therefore, hope for your positive action," reads KMT's letter.

The land includes; Sozi estate on Bugala island-Kalangala, five acres in Munyonyo (FC 17730), five acres in Kitebi (FC 14241), six acres in Kibuye, a square mile at Lwanjiri Ssingo (FC 19846), 159 acres at Wabutungulu, Bulemezi (FC 14143), 10 acres at Nabukalu, Busiro, a castle at Bamunanika, 190 acres (FC 10068) in Butambala Kibuga and six acres that also comprised their matrimonial home at Salama.

Other properties Kagere allegedly took over are shares and stocks in Uganda Breweries Limited, Lake Victoria Bottling Company and Kasujja Farm and Mining Company Limited. At the Administrator General's offices, his wife's file number is registered as Mengo A/c 384/79 under the names Victoria Biyatiriisi Namikka Mpologoma Kamuwanda.

The matter remains unresolved. Meanwhile, Serubyale is also looking for a one Michael Kabugo who allegedly works with Lubowa-based Joint Clinical Research Centre. He claims Kabugo stole an original copy of his land title for 1.29 acres located near Bulange, Mengo.

Kabugo is the one who introduced him to Mutyaba. With no child and wife, Serubyale is now at the mercy of well-wishers who provide food at his home in Masajja B zone along Busabala road. He roams Kampala streets each day looking for scrap or bottle tops and gets paid Shs 500 per kilogramme.

At times, he uses the money to pay tithe in his Najjanankumbi church or cover transport costs whenever he is too tired to walk home.

"You may not believe me but I have survived hunger for 38 years because I don't get my pension. I have been at the mercy of Muslims in town who give me food and another lady, Joweria Namusisi, who stays along Busabala road," he says. "One time, I decided to count the times Namusisi has given me food and they are 140. Where can you find such a good Samaritan?"

KCCA appeals order to pay 100bn to ex-KCC workers

Three months after 1,013 ex-city council employees received the good news of court awarding them Shs100bn in a six-year legal battle, Kampala Capital City Authority's top executive has appealed against part of the High court decision.

In 2012, ten former employees of the defunct Kampala City Council led by Justine Kasule, the former principal assistant town clerk for Makindye, petitioned court. The allegation was that their services were illegally terminated 17 months after KCCA came into being.

They sued the ministry of Public Service, KCCA executive director Jennifer Musisi, KCCA, Attorney General and the Secretary, Public Service Commission. The petitioners challenged the use of "illegal" administrative guidelines issued by the latter with conditions contrary to those under KCCA Act which hired their services.

On April 24, the High court (Civil Division) trial judge Lydia Mugambe ruled that the termination was both embarrassing and inconveniencing -- because the applicants were dismissed unceremoniously before attaining 60 years as per the laws pertaining to civil servants.

Whereas the AG and KCCA had issued intentions to appeal, only Musisi eventually filed a memorandum of an appeal citing eight grounds. She averred that "the learned trial judge erred in law and fact when she held that the respondents were former employees of KCCA entitled to remuneration and other applicable benefits under the KCCA Act, 2010," one of the grounds says.

Mugambe had noted that the former KCC employees had suffered financial distress. She added that they could have invested their retirement packages and earned sufficient profit from them if they had been calculated properly.

"I hereby award each of the applicants general damages of Shs 5 million. However, I am declining to award exemplary or punitive damages. Also, considering that the pain and suffering occasioned to the applicants by both the government and KCCA, the general damages should be paid jointly and or severally by both KCCA and government," Mugambe ruled.

She also ordered that the applicants be paid remuneration and other applicable benefits under the KCCA Act and other laws for the 17 months they worked under KCCA.

Shortly after Musisi's appeal, the ex-workers led by Brian Ssegawa, who was a parish chief of Busega, petitioned President Museveni through the minister in charge of Kampala Beti Kamya.

I arrested Kipoi without knowing his offences - police officer

The police officer who arrested Tony Nsubuga Kipoi, the jailed former Bubulo West member of parliament didn't know the crime he was wanted for.

Kipoi was picked up in 2012 by police officer Bernard Turyamureeba who was then working with the Flying Squad Unit attached to Kawempe police station. Last week, Kipoi's whereabouts became a mystery after he was picked up from Luzira prison where he was earlier remanded.

According the prison authorities, Kipoi was picked from Luzira by Military Police and taken to the High court on the orders of Justice Musa Sekaana. However Kipoi was not presented in court and the General Court Martial denied knowledge of the production warrant used by the alleged Military Police officials to pick Kipoi from Luzira. 

He resurfaced yesterday and Turyamureeba told the General Court Martial chaired by Lt. Gen Andrew Gutti that on December 22, 2012, he received a call from Fred Tumuhairwe, the then assistant commander of the Flying Squad under Kampala Metropolitan Police (KMP) instructing him to report to the late Andrew Felix Kaweesi, the former KMP commander.
 
According to Turyamureeba, Kaweesi instructed him to assemble a team of good officers for a mission to arrest Kipoi. Turyamureeba says he selected three detectives to escort him to Kabarole where they had been instructed to pick up Kipoi on grounds that he had a case to answer at the CID headquarters in Kireka. 
 
The detectives included Sgt Alex Muhairwe, Cpl Wilson Mafabi and Martin Kisitu. According to Turyamureeba, the team set off for Kabarole around midnight and arrived in the morning. He explained that they were received by a one Cpt Kashakamba who is now at the rank of major. 

Turyamureeba told court he couldn't recall the second name of the officer and said Kashakamba directed them to Tmoot hotel where Kipoi was. He explained that upon arrival, they introduced themselves to the gateman before a female receptionist directed them to the gardens where Kipoi was. 

Turyamureeba says they found Kipoi with six others namely Lt. Sam Magomu, Col John Musinguzi Bebwa, Etienne Muhumuza, Cpt Wandwasi, Lt SB Yashin and Simire Dewoba, who they later discovered was a Lt. Col. with the Congolese army. The suspects were reportedly taking tea in a meeting chaired by Kipoi. 

Turyamureeba, who is currently attached to Kiryadongo police station, said upon searching the group, they found Kipoi in possession of Ugandan and American currency notes. He however, didn't tell court how much money they found on Kipoi. Kipoi smiled in the dock while his colleagues looked on in amusement. The officer also said they found Kipoi with other personal belongings including mobile phones.

He told court that Kipoi and his group didn't resist arrest and were taken to a waiting minibus that drove them to the CID headquarters in Kireka. He explained that upon arrival in Kireka, he handed the suspects to the officer-in-charge of CID whose names he couldn't recall. During cross examination, Kipoi's lawyer retired Maj Ronald Iduli asked Turyamureeba if he knew the offences for which Kipoi was wanted before he effected the arrest. 

In his reply, Turyamureeba said he didn't know the offences Kipoi had committed, saying his only role was to arrest him as directed by the KMP commander Kaweesi. Turyamureeba also said that when he arrested Kipoi, he didn't tell him why he was under arrest. He also told court that he didn't record the exhibits/items found with Kipoi. 

"I didn't have any exhibit slips because the items I found with Kipoi, were his personal belongings", said Turyamureeba.  

Turyamureeba also said that by the time he arrested Kipoi, he didn't inform the then Flying Squad commander, Nixon Agasirwe, saying he didn't have formal arresting orders for the former legislator save for the instructions from the late Kaweesi. 

Court Martial chairperson Lt Gen Gutti remanded Kipoi to Makindye military barracks "for his personal safety" until November 19, 2018.  According to Gutti, Kipoi is more secure in the military barracks compared to Luzira maximum prison.
 
Kipoi was extradited from Botswana to Uganda early this year, and charged in the military court together with six UPDF soldiers for offences related to security. Prosecution alleges that between 2011 and 2012 the accused contrived a plot to overthrow President Yoweri Museveni's government.

FDC tells Bududa residents to reject gov't relocation

The opposition political party, Forum for Democratic Change (FDC) leadership has told the people of Bududa to reject any plans by the government to relocate them from their area, saying this could be a plot to take over their land.

Party leaders including president Patrick Amuriat Oboi, Nathan Nandala Mafabi the secretary general, party chairperson Wasswa Biriggwa, Leader of Opposition Betty Aol Ochan and former party president Kizza Besigye were in Bududa to deliver relief items to the October 11 Bududa mudslide disaster that killed over 50 people. 

Besigye said living around the mountains would not be a threat to the people if the government had put in place sufficient measures to conserve the mountains. He says there are many countries in the world which have mountains which are much higher than those in Uganda but they rarely face mudslide problems.

Besigye added that in the early 60s, the colonial government planned and put terraces in the mountains in Kabale district. He says that the same idea needs to be replicated in the Mt Elgon areas.

"They have stolen everything in the country and its only land that is left to steal. Relocating you from your land could be a ploy to steal that land." Besigye said.

After the 2010 mudslide disaster in the same area that killed an estimated 300 people, government bought land in Kiryandongo in western Uganda to relocate the people of Bududa to avoid a repeat of the disaster. However the relocation did not materialise due to rejection by the locals and corruption by the officials in the Office of the Prime Minister (OPM) who were in charge of the relocation. 

When President Yoweri Museveni visited Bukalasi sub-county on October 14 after the mudslide, the chairperson of Bududa district, Wilson Watira told him to expedite the plans of relocating people to safer areas. Museveni apologised to the people of Bududa and said he'd been misled on the relocation of the people from the mudslide-prone areas. He however did not elaborate on how he was misled and by whom. 

Besigye asserted that the biggest problem in Uganda is the lack of systems that can preserve the environment. He says the mudslides would not have claimed lives if there were warning systems to alert people about any impending calamity. 

FDC president Oboi faulted the government for failing to conserve the mountains and hills in Bududa, exposing the population to landslides. He said the people of Bududa must stand against any plan to be relocated and fight for their land saying that they shouldn't leave their wealth behind.

"The mudslide that killed our people would have been avoided. These mountains here can be conserved but Museveni doesn't want to conserved. He wants to force people of Bukalasa to leave their beautiful land, their fertile lands out of sheer negligence. For me, I think its a plan by Museveni to ensure that you people leave here but the question is, who does want this land to be left for? Mu dear people we have to stand firm, we have to protect our land.

Police blocks FDC from donating relief aid to Bududa

Police on Sunday blocked opposition political party, Forum for Democratic Change (FDC) from delivering relief items to the Bududa mudslide victims.

The truck with a consignment comprising mainly of food items was intercepted in Buwangani town near the border of Manafwa and Bududa districts. Bududa district police commander Esther Adeke advised the FDC team led by former party president Kizza Besigye to deliver the supplies to the district disaster committee first that would then distribute the items to the victims depending on need. 

It took the intervention of Besigye, Patrick Amuriat Oboi, the incumbent party president and FDC secretary general Nathan Nandala Mafabi to secure the release of the relief truck held for more than six hours.  

About 60 bodies were recovered from Bududa after October 11 disaster when river Suume burst its banks triggering off floods that washed down everything in the path. Several people were left homeless and in need of essential items. Government emergency and relief response has been slow and inadequate, and even then, locals are accusing officials of misappropriating the little relief aid by selling it to the victims and traders. 

Betty Aol Ochan, the Leader of Opposition in Parliament (LoP) says the police was informed that FDC top party members were travelling to Bududa to take relief items to the affected people.

"We were cleared by Bududa police to go and deliver the relief items to the Bududa mudslide victims but I am shocked that our truck... has been intercepted,'' she lamented.

Aol explained that there was an allegation that the relief items donated to the Bududa victims were being sold cheaply to the people within the community. Samuel Wanda, a resident of Bududa town reinforced the allegation and advised that the items should be taken direct to the affected people to avoid diversion .

Speaking during the handover of relief items donated by FDC on Sunday at Bukalasi sub-county headquarters, Godfrey Wanasolo, one of the victims said most of the items like food, blankets, cooking oil, mattress, saucepans and cups don't reach the intended beneficiaries.

He explained that since the relief items are first given to the district disaster management committee to deliver to them, they disappear before getting to the victims. Matiya Namaleya and Annet Wekoya, both mudslide victims, said they have evidence showing that most of the items are sold off by the local leaders to traders in the neighbouring Bududa town council.

They want donors and government to deliver the relief items directly to the mudslide victims. She said items like blankets, jerrycans, posho are sold at night to the victims and traders wishing to buy cheaply.

Besigye explained that they donated the relief on humanitarian and not political grounds. But Wilson Watira, the Bududa district chairperson accused the FDC leaders for exporting the defiance campaign to the district when they refused to follow the right channels for relief distribution.

He explained that the purpose of taking items to the district disaster management committee is to record and check the quality and safety of the items before they are handed to the victims.

He also refuted claims by the mudslide victims that local leaders are selling the relief items, saying whoever has evidence should be present it to his office for investigations. Watira is the head of the district disaster management committee.

3 days of violence that emptied Angolan town of Congolese

"Occupied," "do not enter," "home of an Angolan" — the writing remains visible on the wrecked houses belonging to Congolese who have gone home as Angola has clamped down on illegal diamond mines and the migrants who worked them.

The destruction in Kapende, where no house remains occupied or intact, marked the culmination of three days of violence in Lucapa, a sprawling mining town in the northeast surrounded by some of the world's richest diamond fields. About 300,000 Congolese have fled Angola in the last few weeks, many of them in response to the violence in Lucapa at the beginning of October.

For many in the town, the violence was shocking in an area that had turned a blind eye to Congolese migration and where digging for diamonds provided a living. Politically, the upheaval threatens to further destabilise Congo ahead of elections in December and harm relations with Angola, an old ally.

In interviews with 14 eyewitnesses as well as an Angolan security source, Reuters has pieced together the events of October 3, 4 and 5, detailing for the first time the ethnic violence, police action and looting that forced half the city to flee to the border and into Democratic Republic of Congo.

The accounts of death and pillage contradict assertions by the Angolan government that Congolese migrants are returning home voluntarily and that only one person died, in a traffic accident. Angola denied accusations of massacres and abuses.

It says it is asserting its right to ensure national security and protect its natural resources. Angola says the effort, which it calls Operation Transparency, is part of a drive to reform the diamond sector and increase revenues from the country's second largest export after oil.

Although home to some of the world's most exciting diamond prospects, Angola has long been shunned by major mining companies due to corruption and a lack of transparency. The government has vowed radical change to put its sector on a par with Botswana and South Africa.

Human rights

The United Nations refugee agency says it is concerned by the worsening humanitarian situation as throngs of people arrive in Kasai, a part of DRC where conflict killed up to 5,000 people and displaced 1.5 million in 2016 and 2017. DRC summoned Angola's ambassador, demanding a "comprehensive investigation to establish who is responsible for these wrongful acts."

Reuters was unable to establish how many people died in Lucapa, but witnesses said the toll was at least eight. An Angolan security source with knowledge of the operation said between 10 and 14 had been killed. Congolese who fled Lucapa and were interviewed by Reuters across the border said the number was higher.

It remains unclear how many deaths were the result of police fire or of ethnic violence, but at least three people were killed by law enforcement, according to witnesses.

Pedro Sebastiao, Minister of State for Presidential Security and head of Operation Transparency, said, "They are completely false, the claims of massacres, abuses and violations committed by the authorities or by Angolan people."

Local resentment

The screams were the first sign something was wrong in the neighbourhood of Roque, on Lucapa's west-side, said Corneille Mbala, a 42-year-old mining supervisor. A group of locals from the Tchokwe tribe burst into houses of Congolese migrants on the morning of October 3.

"They threatened to kill me and my wife," Mbala said. "We fled, leaving everything we possessed behind."

He said five of his friends were killed by the mob in Roque that morning, butchered with machetes. Mbala escaped to Santa Isabel, a neighbourhood the violence had not yet reached.

The authorities had been using local Angolans from the Tchokwe community to spy on the town's Congolese, witnesses said. A few informers began looting houses of those that had left. Others joined and a mob formed, threatening occupied homes.

The Tchokwe people, dominant in this part of Angola, have long resented Lucapa's immigrant Congolese community, many of them from the Pende tribe. They said they resented their arrogance, flashy cars and fancy clothes — bought with money from diamond digging.

Although illegal, Lucapa's diamond trade was not hidden. Buyers known as bosses put their faces on billboards and Land Cruisers as if running for political office.

"The lion of Lucapa, brother of the artisanal miner," ran one slogan. "Always loyal to the client," read another. While the bosses built luxury homes, most of Lucapa lived in squalor.

Mountains of trash run through town. Poorer neighbourhoods are reachable only by motorbike, along narrow muddy paths.

"This was one of the last places in the world you could become a millionaire overnight," said Jorge Felix, a 50-year-old Cuban who works on legitimate diamond projects in the area. "But none of the money stayed here. There's no water, no electricity, nothing."

The fight back

On October 4, the Congolese fought back. Many grabbed machetes to defend themselves from looting. Reports spread that the Pende were arming themselves with bows and venomous arrows, according to local residents. About 200 Congolese men marched shouting toward the main police station sometime before midday, two eyewitnesses said.

The group clashed with Angolans outside a school, with a young girl slashed in the head with a machete. She later died in hospital, the sources said. Police fired warning shots and dispersed the crowd. Fighting continued to flare up across town. An Angolan security source with knowledge of the operation said Lucapa police called the provincial capital Dundo for backup.

The law enforcement that arrived to restore order were the Rapid Intervention Police (PIR), an elite heavily-armed branch. On Friday morning, eyewitnesses said members of the PIR and Chacal, Angola's Israeli-trained special forces branch, entered the neighbourhoods of Kapende and Santa Isabel.

In Kapende at least one man was killed by law enforcement, according to eyewitnesses, while in Santa Isabel at least two died at the hands of the authorities. Witness testimony suggests four others were injured in the fighting and taken to hospital. Reuters visited the hospital, but doctors declined to say how many people they had treated for conflict wounds, saying local government permission was needed.

It was not given. With their homes looted, the Congolese left in droves. Some packed into huge green trucks rented by the government, others paid to be driven in Land Cruisers or rickshaws to the border. Some just walked, sleeping in the open.

When Reuters visited Kapende on October 19, a few lonely figures scavenged for what little was left, cutting out a few bricks from a destroyed church and hammering an axle off a burnt-out car. Everything else had gone.

At the border, the flow of migrants had slowed but hundreds were still crossing.

"There's nothing for me on the other side, I have no family," said Kafundanga Dominque, 30, lugging a rolled-up mattress. Staring toward Congo, he said: "I'm already dead."

Uganda can't achieve middle income status by 2020 - minister

It's nearly next to impossible that Uganda will leapfrog into middle income status by 2020 as has been hyped by government, Finance minister Matia Kasaija has said. 

President Yoweri Museveni has over the recent years boasted that Uganda was on course to achieve middle income status by 2020, because now it's no longer about resources availability but prioritisation. 

According to Kasaija, there are a number of factors that have curtailed Uganda's quest for a lower middle income status, two of them being inability to execute key infrastructure projects and an increasing population that does not match economic growth.

"We're on course, we're definitely on course but whether we shall hit it by 2020 is a bit of challenge. There are two things that have happened. One, some of the projects that we wanted to implement, we have not implemented them for various reasons which I am not ready to disclose now. Two, the increase in population when it comes to getting that average of $900 per capita by 2020 could call for a challenge." Kasaija added. 
 
The World Bank defines a lower middle-income economy as one with income per capita of between $1,006 and $3,955. Uganda's per capita income currently stands at $666 dollars - equivalent to just over Shs 2 million. In the East African Community, Uganda falls behind Kenya, Rwanda and Tanzania in per capita income and other indicators of socio-economic development.
 
Minister Kasaija adds that delays in development of the oil and gas sector as well as the sluggishness of modernisation of agriculture have also affected the march to middle income status, although he insists that the country is on course.

"We have not moved fast on our oil for various reasons, modernisation of agriculture has not moved at the speed at which we wanted it so there's a bit of a challenge. but as far as pursuing it." he added. 

Development economist Dr Fred Muhumuza, in a telephone interview, says Uganda is definitely not ready to become a lower middle-income country nor at take-off stage because she's still struggling with debts, low revenue collection, low and unstable growth and, as he puts it, "a very very poor population".

Achieving lower middle status, with per capita income of over  $1,000 underlined Museveni's re-election campaign in 2016. 
 
From then on, the quest for middle income status became the mantra for government officials and official communication until now when the reality is dawning that that target is a tall order.

Did Kamya push Musisi?

The appointment of Beti Olive Namisango Kamya in June 2016 as minister for Kampala Affairs might have hastened the exit of Kampala Capital City Authority executive director, Jennifer Ssemakula Musisi.

Musisi announced mid this month that she was resigning her position – an announcement, which insiders at the authority said did not come as a surprise at all. The city authority is going through some tough times. Already, most of its top directors have resigned despite the handsome pay.

Morrison Rwakakamba, a former presidential assistant for research, said on the Capital Gang radio show at the weekend that Kamya's appointment informed Musisi's need to leave.

"I think for the past two years, she [Musisi] realised that without the president's direct support, there was no way she was going to navigate all these contradictions [at City Hall]," Rwakakamba said.

"When Kamya came on board, she was brought to try and bring back the people into the fold of how Kampala is run. To bring back people into supporting the government of the day. That contradiction and contestation happened and you will realise that since Kamya came as a minister for Kampala, Musisi's visibility [diminished]… you could see that things at City Hall were not moving in the right direction," he added.

He said Frank Tumwebaze, now the minister for ICT, and former minister for Kampala, had "allowed [enough] bandwidth for Musisi to take charge and be able to do a lot of things and she really had done a lot of things."

Kamya's appointment came just months after President Museveni had been badly trounced in Kampala in the 2016 polls. On giving the diagnosis of the results at his Rwakitura home, Museveni said Musisi's actions, which included eviction of city vendors, had led to his party's terrible performance in Kampala.

Kamya hit the ground running, promising Museveni that she would "deliver Kampala with 80%" of the vote in 2021. This meant undoing some of the things Musisi had done. It also meant alienating her.

This quickly developed into a fierce feud between Musisi and Kamya. It reached fever peak in May last year when Kamya described the former as "a populist" and "poor manager" while on a radio talk show at CBS hosted by Meddie Nsereko.

"Musisi has become a populist; you discuss something and then she rushes to leak it to the media," Kamya said.

"We meet every Monday. Us the two ministers, the undersecretary, Musisi and her team. There is always an opportunity for her to ask anything she wants but when you bypass those channels and instead run to do your work from the media, then you've become a politician."

"That populism can't take us anywhere; I don't fight petty wars but what I don't want is populism," she added.

Kamya then went on to accuse Musisi of being responsible for the high turn-over of workers at the authority, asserting that something was wrong.

"Whenever there is a high staff turnover in an organisation, just know there is a problem with management. The main role of a manager is to create a conducive/favourable working environment for your workers. That's when you can get the best out of them," Kamya said.

The minister accused Musisi of intrigue.

"All the issues I have dealt with like removing vendors from the streets, demolishing Park Yard [market], streamlining taxi and boda operations, it was Musisi who invited me to handle them, saying they were too heavy for her because they involved police and politics," Kamya said.

The feuding deepened towards the end of last year when Kamya sought to lure city councillors, most of whom are opposition members, to the ruling party side by ordering Musisi to increase their salaries by 30%.

This proposal was trashed by Musisi who argued that the authority did not have money. For Kamya, according to one worker at the authority, this was equivalent to stepping on her plan to win Kampala for Museveni.

Asked last week to comment about Musisi's exit during a press conference she convened at her office in Kampala, Kamya was careful not to say much. She simply acknowledged that she had differences with Musisi but saluted her as a great performer.

The infighting and intrigue made Lord Mayor Erias Lukwago, an official whose run-ins with Musisi are legendary, look like the understanding party at the authority. In fact, Lukwago told journalists in his office last November that the new salary structure as proposed by Kamya had stalled "because the two could not work with each other".

To Lukwago, the Kampala minister had powers to increase salaries for political leaders of the city. These accusations, which sprung up daily in the media, broke Musisi, intimated a top official at City Hall.

"Someone accuses you of going to the media but is herself using the media to attack you…How do you comfortably work together?" the official told The Observer on Monday.

In her resignation letter, Musisi cited political interference and inadequate funds as factors that led to her exit.

Analysts said the deep cuts in the authority's budget this financial year, now down to slightly over Shs 382 billion from Shs 477bn, was seen as a final blow.

Museveni, her biggest cheerleader when she took office in 2011, had started visiting different groups in Kampala dishing out money. He carried Kamya along. The executive director, formerly 'daddy's little girl', was apparently not invited.

This, according to those familiar with politics at City Hall, showed where president's favour fell: to the minister who knew what the next election meant and not the technocrat who cared less about polls.

As at Tuesday evening, President Museveni had not responded to Musisi's letter amid growing speculation that he might reject her resignation.

Retirement: Museveni stumbles 5 times

For the past few weeks, President Museveni has been touring Kampala and its environs in what political pundits see as an extension of his early campaign for a record sixth elective term as president.

These manoeuvrings seem to have been given added urgency with the emergence of Kyadondo East Member of Parliament Robert Kyagulanyi (Bobi Wine). The MP's message for change, and a new liberation, is resonating with Uganda's youth who constitute majority of the country's 40 million people.

Kyagulanyi was barely five years old when the NRM shot to power 32 years ago. If Museveni had honoured his word to retire those many years ago, it is unlikely that Bobi Wine would have abandoned his music for politics.

Now, the musician finds himself in the strange position of joining the effort to send Museveni home after more than three decades in power. In the earlier years of his presidency, Museveni had often talked about transition to another leader. 

In his book Sowing the Mustard Seed [1997 edition], Museveni writes that the NRM had only two cardinal roles; one being the laying of a firm foundation and preparing the ground for security and political stability. The other being to ensure orderly succession of political authority. 

"Looking further ahead, I'm optimistic about Uganda's future. Our present line of progressive development might get delayed along the way, but I don't anticipate any serious breakdown as happened in the past, unless we get confused political groups in charge. They might delay the industrialisation and economic liberalisation process but the fundamental principles are now in place. There are now people of presidential calibre and capacity who can take over when I retire and I shall be among the first to back them," Museveni wrote.

But he was to contradict himself years later in the 2000s, astonishing the country with the claim that he was the only one with a vision to lead Uganda. Museveni has also over the years kept on flip-flopping on his retirement. We look at some of the promises.

Four more years

In his book Sowing the Mustard Seed, Museveni writes that when they came to power in 1986, the NRM formed the National Resistance Council as the national governing body; the equivalent of the present-day parliament.

Immediately after taking over the reins of power following a protracted five-year guerrilla war, the NRM established itself with the passing of Legal Notice 1  of 1986, which provided that "The National Resistance Movement government shall be an interim government and shall hold office for a period not exceeding four years from the date of this proclamation which, shall be deemed to have come into force on the 26th day of January 1986."

Museveni wrote that this meant that the interim period was due to end on January 25, 1990.

However, as the interim period neared, in 1989, Museveni influenced the expanding of the NRC through indirect elections. He argued that they chose indirect elections because of logistical challenges. He said they did not have enough money or vehicles to mount a full national ballot with most of Uganda's roads still largely impassable.

To him, this answered the promise to surrender power after four years.

"Originally, we had said that the group which took power in 1986 would be in government for four years and we kept that promise; before the end of the four years a new group had come in. The expanded NRC of 1989 was not the same as the old one of January 1986," Museveni wrote.

However, to people like Wasswa Ziritwawula (a former NRC member who resigned in protest), this 'usurpation of the people's power' was the first step in Museveni's quest for life presidency.

Retire at 55

On July 20, 1995, Museveni told residents of Kisoro district that he was on his way out.

"When I reach 55, I will not be in public life anymore, I told you this when I was 48. I'm ready to help Ugandans and Africa in public life up to the age of 55," Museveni was quoted as saying in The Monitor of July 21-24,1995. Going by that promise, Museveni shouldn't have contested the 2001 elections. It was that same year that he wrote in his election manifesto that 2001 was the last year he was standing for president.

In October that year, he gave an interview to the BBC in which he said he was desirous of leaving power at the end of his two constitutional terms. This too was not to be.

Almost immediately after being sworn in as president for the second and final elective term, voices started emerging within the NRM calling for the lifting of term limits. In 2005, term limits were scrapped after the bribing of MPs with Shs 5 million.

Age limit

After doing away with term limits, the only legal impediment to the life president project were the age limit provisions for presidential candidates in Article 102(5) of the Constitution.

Prior to the amendment of the constitution, Museveni had unequivocally told NTV's Patrick Kamara that there was, certainly no chance of him standing as president beyond 75 years.

"I think there is some scientific idea that maybe the vigour is not as much after 75 years, so that one I wouldn't quarrel so much…I know there are some leaders who have been leading even beyond 75 but I think if you want very active leaders, it is good to have the one below 75."

UCC grants MTN 30-day provisional licence

The Uganda Communications Commission (UCC) has granted a 30-day provisional licence to telecom giant, MTN Uganda. MTN's 20-year licence expired on October 20, 2018.
 
Eng Godfrey Mutabazi, the executive director of UCC said today Tuesday that MTN was not ready for licence renewal by the time its licence expired on Saturday.

"When they are ready, it will be issued. We are still working out some modalities. We have given them a 30-day provisional licence," he said.  
Mutabazi said MTN will get a 10-year licence before the expiry of 30-day provisional licence. MTN Uganda was granted a licence on April 15, 1998 but it took effect on October 20, 1998. MTN commands the largest market share in Uganda with over 12 million subscribers' base. MTN over the weekend held an expo at Kololo airstrip to celebrate 20 years of success in Uganda.
 
The process for licence of renewal started a year ago when Mutabazi revealed that UCC had received application from MTN.
 
"Take notice that the Uganda Communications Commission has received an application for renewal of a National Telecommunication Licence by MTN Uganda Limited for the provision of telecommunication services within the Republic of Uganda. MTN Uganda Limited seeks to have its license renewed for ten (10) years commencing on October 21, 2018," Mutabazi said in a statement dated October 26, 2017.  

Cabinet last month gave UCC ago ahead to renew MTN's licence. However, the new licence is supposed to come with stringent terms as laid out in the new national broadband policy.  

The new licensing conditions for instance include listing on Uganda Securities Exchange (USE), covering entire geographical coverage of Uganda, national roaming, among others.  

Information, Communication and Technology (ICT) minister, Frank Tumwebaze said these stringent conditions will apply to other telecom companies as well when they apply for licence renewal. 

"Cabinet tasked the minister for ICT and Uganda Communication Commission to work with attorney general to ensure that the operator licence for MTN has clear terms and conditions that aim at ensuring quality of service," Tumwebaze told journalists last month when unveiling a new broadband policy.
 
MTN Uganda CEO Wim Vanhelleputte and MTN corporate affairs manager Val Oketcho did not pick repeated calls for a comment.

Kitatta obtained firearms from police - CMI

Jailed patron of vigilante-cum-militia outfit Boda Boda 2010 Abdullah Kitatta obtained fire arms from the Uganda Police Force, the General Court Martial sitting in Makindye heard on Monday.

Maj David Agaba, the commander of operations in the Chieftaincy of Military Intelligence (CMI) told court that Kitatta confessed to him that he received firearms from police.

Kitatta is battling charges of illegal possession of firearms together with twelve others. The other suspects are; Matia Ssenfuka, Joel Kibirige, Hassan Ssemata, Jonathan Kayondo, Ssengooba Hassan, Sande Ssemwogerere, John Ssebandeke, Hussein Mugema, Fred Bwanika and Amon Twinomujuni. 

The suspects were allegedly found in possession of two pistols, an AK-47 rifle, 55 rounds of ammunition and four army uniforms belonging to the Uganda People's Defense Forces (UPDF). The suspects were arrested in a joint swoop from Busega and Wakaliga in Rubaga Division on January 19, 2018. 

Agaba appeared before the Court Martial on Monday as the third witness since he commanded the operation that led to the arrest of the suspects.
 
He told court that in his 20-year service in the military he had never seen a gold-coated pistol that Kitatta was found with when he was picked up from Wakaliga, adding that he is still wondering where the suspect got the pistol. Agaba explained that during interrogations, Kitatta told them that he secured the pistol from top leaders in police. 

The officer, who couldn't complete his testimony due to shortage of time, said Kitatta was arrested for blocking operations to arrest the suspected killers of Francis Ekalungar, the accountant of Case of Clinic. Court Martial chairperson, Lt Gen Andrew Gutti adjourned the matter to later today to allow Agaba to complete his testimony. 

Kitatta, who was in court, appeared too weak and only stood with the help of his co-accused.  Lt. Gen. Gutti later allowed him to seat when his lawyer, Shaban Sanywa notified court about his ill health. Kitatta has made two attempts to secure bail. The state is yet to respond to Kitatta's bail application. 

Last week, the military court denied his co accused Joel Kibirige bail on grounds that he is likely to sabotage evidence since their trial has already started.

Lawyer Wanyoto runs to High court to block fraud trial

City lawyer, Paul Wanyoto Mugoya has petitioned the High court seeking to block his trial together with eight others in the Anti-Corruption court for alleged fraud and kidnap.
 
Wanyoto is accused alongside Samuel Nabeta Mulowooza, the managing director Eye Power Engineering Company and police officers, Siraje Bakaleke, Robert Munezero, Innocent Nuwagaba, Robert Ray Asiimwe, Junior Amanya, Babu Gastavas and Kenneth Zirintuusa. 

The suspects are accused of extorting Shs 1.4 billion from Park Seunghoon and Jang Shingu Un, both South Korean nationals who had come to Uganda to purchase gold last year.  
 
The officers reportedly connived with Wanyoto who was representing the South Korean businessmen and placed them at gunpoint at Acacia Mall in Kampala. The Koreans were locked up at Katwe police station before police officers procured for them air tickets with intentions of deporting them on the orders of assistant commissioner of police (ASP), Siraje Bakaleke.

However, the suspects were intercepted by security operatives before deporting their victims and dragged before the Anti-Corruption court. Now, Wanyoto who has never appeared before the Anti-Corruption court to plead to the charges, has rushed to the Civil Division of High court seeking an injunction to block his trial, arguing that the charges against him were sanctioned in bad faith. 
 
Through his lawyers of Web Advocates and Solicitors, Wanyoto contends that the DPP acted under the influence of the commandant Criminal Investigations Department of Kampala Metropolitan Area well-knowing that there is no formal complaint against him or sufficient evidence to support the charges.

In his affidavit, Wanyoto states that he is a director/shareholder in Ms. McKinley Resource Company Ltd together with Jang Seungkwon, Park Seunghoon and Ha Dong, whom they agreed with, to independently transact monies on their dollar and shillings account in Diamond Trust Bank. The agreement was reached on January 25, 2018 after the registration and incorporation of McKinley Resource Company Ltd according to the documents before court.
 
Wanyoto alleges that it was agreed that the monies be secured from their Korean counterpart particularly Wang Yu, who is the collective principle and be remitted to the company account in Diamond Trust Bank.  
 
This was reportedly done to comply with the regulatory and legal frame works regarding a foreign company before commencing business in Uganda. Wanyoto explains that $480,000 was remitted to the company account. 
 
He notes that before they could fully resolve the matters, his co-directors/shareholders were arrested on allegations of terrorism and money laundering. According to Wanyoto, he received a phone call from Park who was locked up at Katwe police station informing him about their arrest.
 
He explains that after confirming the charges against his business partners, it was agreed that he withdraws $415,000 from the company account. Wanyoto notes in the affidavit that Park and Ha instructed him as their lawyer to help secure their release and freedom. $30,000 was disbursed to him as instructions or legal fees. 
 
"Indeed the following day, I managed to secure the release of Jang, Park and Ha Dongsub", reads Wanyoto's affidavit in part.
 
After their release, Wanyoto says they agreed that the South Koreans travel to Dubai to shed off their nasty experience before returning to Uganda. He explains that he later handed over $415,000 to Ha in the presence of his co-directors Jang and Park and they parted ways since the group was heading to the airport.
 
Wanyoto says the decision by the police and DPP to slap charges against him was unreasonable and abuse of administrative power since there is no complainant in the case and no proof that he caused a financial loss to the company where he is a co-director. 

He says the actions by police and DPP are meant to abuse his fundamental human rights and freedom since he did his job of securing police bond for his co-directors as agreed. Wanyoto now wants the High court to issue a permanent injunction against the proceedings in the Anti-Corruption court. 

He also wants court to declare the actions of police and DPP as illegal, saying they are trumped up. Wanyoto is the second person seeking orders to block these proceedings. Bakaleke also raised similar grounds seeking to block the trial. 

Their co-accused have since appeared in the Anti-Corruption court and pleaded not guilty to the charges and were granted bail of Shs 7 million in cash with the exception of Asiimwe who doesn't have sureties. Court is yet to fix Wanyoto's application for hearing.
