Cosase bribery: IGG orders ISO to investigate Katuntu

The Inspector General of Government (IGG) Irene Mulyagonja has asked the Internal Security Organisation (ISO) to investigate the former chairperson of Cosase committee Abdu Katuntu for allegedly soliciting bribes during the recent probe into the irregular sale of commercial banks.

The directive by the IGG is based on a complaint from an undisclosed person, that Katuntu, the former parliamentary committee on Commissions, Statutory Authorities and State Enterprises (Cosase) deputy Anita Among, Kasilo County MP Elijah Okupa, and Aruu North MP Odonga Otto regularly met former Crane bank owner Sudhir Ruparelia during the course of the bank probe.

It is alleged that the said committee members received cash payments from Ruparelia and his son Ranjiv Ruparelia which is suspected to be the real reason they refused to yield the leadership of Cosase when their term ended, according to the letter by the IGG. 

Handing over the leadership of Cosase became a contentious issue between the Forum for Democratic Change, speaker of parliament and the Cosase leadership.

Whereas FDC wanted Katuntu and Among to hand over leadership to Mubarak Munyagwa and Moses Kasibante respectively when their tenure ended, the duo resisted, insisting that it was only the speaker Rebecca Kadaga who would make the call.

Eventually, Kadaga ruled in their favour to allow them complete the probe and report writing process. However the report has been dismissed as a waste of resources by the general population and several MPs after it made blanket recommendations without specifying the culprits. 

The whistleblower accuses Katuntu of receiving a bribe of Shs 400 million from the central bank governor Emmanuel Tumusiime Mutebile, to allegedly enable the same committee to carry out a benchmarking exercise with other central banks. But, according to the whistleblower that money was not declared by Katuntu and not accounted for.

The whistleblower alleges that the compromising bribe was one of the reasons why the governor was allegedly allowed to pretend that he knew nothing about the closed banks and was never put on oath and was not clearly examined like other Bank of Uganda officials.

The request for investigations into Cosase members was confirmed by the speaker Kadaga after receiving a copy of the letter which is addressed to the director general of ISO, Col Kaka Bagyenda. She said that the letter dated February 19, 2019, would be availed to the Prime Minister Ruhakana Rugunda.

Padyere County MP Joshua Anywarach had earlier demanded that the prime minister pronounces himself on the letter which he said was deliberately meant to tone down the report on the irregular sale and closure of commercial banks. Katuntu is also being investigated for his interests in the defunct Global Trust bank. 

"Hon Abdul Katuntu was one of the debtors of Global Trust bank at the time when the bank was closed on 25th July 2012. He owed the bank approximately Shs 180,000,000, a matter he did not declare yet the debts were amongst the causes of the bank's collapse," further reads IGG's letter.

Mulyagonja concludes that her office decided that ISO is in a better position to investigate the allegations. She requested Col Bagyenda to file a copy of a report of their findings and action taken on the conclusion of the investigation.

Bashir establishes emergency courts, reshuffles military staff

Bashir declared a national state of emergency last Friday and sacked state governors, replacing them with officials from the military and security services. Dozens of doctors staged peaceful protests in the capital Khartoum and other cities Tuesday, chanting slogans in the halls of several public hospitals and demanding that Bashir step down.

Hundreds of students also continued protests at Sudan's oldest university for women, in the city of Omdurman. Neighbouring Egypt and some Western countries including the United States expressed concern about the situation in Sudan, which has been shaken by almost daily demonstrations since December over the rising cost of living and other grievances.

As well as having emergency courts set up in every Sudanese state, Bashir also reshuffled some senior military staff on Tuesday. He switched the positions of several members of Sudan's eight-strong military staff council and appointed General Essam al-Din Mubarak as minister of state in the Defense ministry.

"These are normal, routine changes that happen from time to time," a military spokesman told Reuters.

A coalition of opposition lawyers denounced Tuesday's moves as unconstitutional.

'Deep concern'

Bashir, who came to power in 1989 in a military coup, issued a raft of edicts Monday banning unlicensed public gatherings and awarding sweeping new powers to police.

Security forces were given the power to search any building, restrict movement of people and public transport, arrest individuals suspected of a crime related to the state of emergency, and seize assets or property during investigations.

The United States, Britain, Norway and Canada issued a joint statement expressing "deep concern" over the situation.

"There remains a clear need for political and economic reform in Sudan that is fully inclusive, and which addresses the legitimate grievances expressed by the protesters," it said.

Egyptian Foreign Minister Sameh Shoukry, speaking to Reuters on Tuesday on the sidelines of a U.N. Human Rights Council conference in Geneva, said Egypt stood ready to help its southern neighbour if required.

"We believe that the Sudanese and Egyptian peoples have a common history and a common future, and definitely anything that disrupts the security, stability and prosperity of the Sudanese people is of utmost concern to us," Shoukry said.

Police declines to renew licences of 130 private security firms

The inspector general of police, Okoth Ochola has declined to renew the licenses of private security organisations (PSOs) until their employees and criminal records are fully audited.

As a result, more than 130 privately registered security firms have been operating without licenses since December 31, 2018 when their old licenses expired. Recently, Ochola disclosed that the director of operations Uganda Police Force, Asuman Mugyenyi presented a list of the private security firms and their contracts to his office for renewal but he declined to sign them.

A committee led by Mugyenyi has since been set up to evaluate the performance of the private security firms and the criminal liability brought by their employees. Police records indicate that 80 per cent of the robberies at guarded premises are masterminded by the security guards. 

For example, security guards are believed to have played a key role in the recent attempted robbery at dfcu bank branch in Bwaise where one of the employees was raped for refusing to open the strong room.  
 
The two guards who were attached Securex Security firm vanished after the attack. A detective who has been investigating robberies cases for the last six years told URN that most of the private security firms barely know their employees and don't help police to track the errant guards.

"First they don't take criminal liability or whatever liability for the actions of their employees. Even when these people go on the run, they never help looking for them yet they are supposed to know them better, " the detective said. 

Efforts by our reporter to get a comment from the chairperson of Private Security Organisations Association, Faizal Kazoora were futile as he couldn't be reached on his known phone numbers.

Fear as stray lions invade Kihihi

Residents of Rushoroza parish in Kihihi, Kanungu district are living in fear because of stray lions that invaded the area. On Monday five lions escaped from Queen Elizabeth national park in Kihihi sub county into the community.

The lions ate two goats in Kazinga village but were dispersed by police and Uganda Wildlife Authority (UWA) rangers as they attempted to run after locals.

Nelson Natukunda, the Kihihi sub county LC III chairperson, said the officers managed to push back four lions into the national park when they fired in the air. He however, says one of the lions managed to get away and is still at large.

Moses Tumuranze, one of the residents of Kazinga village, says the presence of the lion in the area has caused panic among residents. Tumuranze says the remaining lion could kill more animals and harm residents.
 
He says both the police and UWA rangers are yet to return to track down the lion and return it to its habitat. Last month, stray elephant destroyed several crop gardens in Kameme and Matanda parishes in Kihiihi.

500 Ugandans stuck on heart surgery waiting list

More than 500 people in need of heart surgery are stuck on the Uganda Heart Institute (UHI) waiting list.
 
Majority of the cases on the waiting list are children who make over 300 patients whose treatment is delayed by the absence of equipment and supplies to perform the surgeries.

Surgeries are required to repair or replace aortic dissections and valves that are not working correctly, to correct irregular heart rhythms such as atrial fibrillation or ventricular tachycardia and to fix or treat genetic heart defects.

The most common heart complications in Uganda are rheumatic heart disease, Coronary artery, and abnormal heartbeats. Persons with coronary arteries require a coronary artery bypass graft (CABG) procedure, in which the blocked portion of the coronary artery is bypassed with another piece of blood vessel.

UHI executive director Dr John Omagino says that the institute has the capacity to treat more than 85 per cent of all heart defects recorded in the country, but has failed to clear the backlog due to insufficient funding. Dr Omagino says that many of the surgeries have remained pending for more than two years despite the availability of specialists to handle the procedures. 
 
"We have limitations in terms of space and operational budget. Many people know what to do to access treatment here but the waiting list is about 500. We don't have space and enough operational budget." he said. 
 
Dr Omagino says that the facility requires more funding and space to accommodate patients before, during and after the surgeries. The Uganda Heart Institute receives Shs 4.7 billion to finance its operations every year, which according to Dr Omagino, is a drop in the ocean due to the enormous need for services.

This, plus the lack of supplies leaves the patients stranded. Dr Omagino says that the institute would require up to Shs 19 billion for its operations. 
                                                                                                                                                                              
"Our parliament took a resolution on the 16th of February last year to give us that money but it has not been given. We're late, patients are waiting but the money that was promised by parliament has not come. Even in the president's second budget call circular, they have not included it. Right now the domestic arrears is about a billion shillings. The gap we have as of now for the next one year using the available."

Meanwhile, medics observed that the cost of receiving treatment at the institute is cheaper compared to other countries like the US and India, where many Ugandans with cardiac diseases have sought treatment. The surgery costs up to Shs 18 million (about $5,000) at the Uganda Heart Institute compared to India where on average one needs Shs 23 million ($6,500).

Christine Katusiime, a patient with rheumatic heart disease from Mbarara who was operated on four years ago in India says that the government needs to ensure that Ugandans get surgeries when they need them.
 
Dr Michael Oketcho, the head of pediatric surgery at the UHI says that the government needs to pass the national health insurance bill to bring lifesaving services closer to the people who need them.

"On estimate, 8,000 babies need surgical interventions for different heart disease but we can only carry out 100. Most of our patients do have money and are forced to remain on medication until they raise enough money to cover the cost of their treatment.

Mexico president sells predecessors' bulletproof cars

Obrador has eschewed the traditional trappings of power since taking office on December 1. He uses a compact Volkswagen car and refuses to live in the sprawling presidential residence compound, instead remaining in a middle-class condo.

He has pledged to sell off the presidential jet and instead uses commercial flights. He also disbanded Mexico's equivalent of the Secret Service. Obrador said Monday that 196 of the 218 vehicles were sold at auction, bringing in $3.25 million.

Surprisingly given Mexico's violence problem, almost all of the 22 vehicles that didn't sell were bulletproof SUVs. Obrador said the money raised would be used for social programs.

Katuntu finally hands over Cosase leadership

Kawempe South member of parliament Mubarak Munyagwa has finally assumed the leadership of the parliamentary committee on Commissions, Statutory Authorities and State Enterprises (Cosase).

He replaces Abdul Katuntu, the Bugweri County MP who was dropped by the Leader of Opposition in Parliament (LoP) late last year but had his tenure extended by speaker of parliament Rebecca Kadaga so as to complete the probe into Bank of Uganda's role in the closure of commercial banks. 

Cosase is one of the four accountability committees of parliament mandated to examine the audited accounts by the auditor general detailing the appropriation of government funds to different commissions, authorities and enterprises. While handing over to Munyagwa on Monday, Katuntu regretted that the process had been delayed by investigations into the closure and sale of seven commercial reports, whose report was tabled in parliament last Thursday. 

He told Munyagwa that despite the fact that Cosase is one of the interesting committees, it has a backlog of reports to handle. According to Katuntu, Cosase has been able to handle just 14 of the 112 statutory bodies during his two and half year tenure in office.
 
Katuntu explained that they zeroed in on the 14 institutions because of the huge budget allocations they receive. He advised Munyagwa to analyze the budgets allocated to all the institutions to guide his leadership. 

He also said that it was important to look at the budgets allocated to the institutions hand in hand with the auditor general's report, which usually highlights accountability issues.
 
Katuntu added that other than the 14 institutions handled, his leadership completed and wrote a report on the beneficiaries of the so-called Shs 6bn presidential handshake, a report on the Centenary Park land row between Kampala Capital City Authority (KCCA) and Nalongo Estates and other reports laid on table yet to be debated by parliament.
 
He said that his biggest success was to produce a number of reports without minority reports from members. He urged Munyagwa to work hand in hand with all committee members regardless of party affiliation. 
 
Katuntu also cautioned his successor to be aware of the difficulty of raising quorum when handling business before the committee and pledged his support whenever called upon. In his acceptance speech, Munyagwa described Katuntu as a great personality and a brilliant lawyer he was replacing. He appealed to the public not to compare his working methods with Katuntu because they are totally different people.

Asked what he is going to do first as the new Cosase chairperson, Munyagwa said that he was going to meet the clerk to parliament attached to the committee and come up with a work plan, which will be discussed by the entire committee.

Munyagwa also noted that he wasn't assigned a vice chairperson, saying that he was to meet the speaker and LoP about the matter. 

LoP Betty Aol Ocan had assigned Rubaga North MP, Moses Kasibante, an independent to deputize Munyagwa but Kadaga assigned him to the Appointments Committee. He assured the public that he was more than able to steer the committee having served as Kawempe Division mayor before joining parliament. 
 
Asked about pending corruption case against him before court, Munyagwa said that he should be given chance to serve, adding that he is innocent until proven guilty.

Bad Black quizzed by police for insulting Museveni

City socialite Shanita Namuyimba also known as Bad Black has been quizzed by the Criminal Investigations Department (CID) for allegedly abusing and defaming President Yoweri Museveni on social media. 

Bad Black arrived at the CID headquarters in Kibuli at 9am in the company of her lawyer Julius Galisonga. She was led to the Media Crimes Directorate office and questioned by two detectives about the video which she posted on social media in August 2018 at the time Kyadondo East member of parliament Robert Kyagulanyi alias Bobi Wine was held in military custody on charges of treason. 

In the video in question, Bad Black while trying to explain that there is no way Bobi Wine could have stoned the president's vehicle, vulgarly abuses the president. In the video, she also claims that President had impregnated her and then forced her to abort. Bad Black now faces charges of offensive communication and criminal libel contrary to provisions of the Computer Misuse Act and Penal Code Act respectively.

During the 5-hour interrogation, Bad Black told the detectives that she had been paid to send out the video.

"They had paid me to defend Bobi Wine and abuse Museveni but I have since realized my mistakes and I won't do it again," she said even before entering the interrogation room.

Police spokesperson in charge of Criminal Investigations Vincent Sekate said Bad Black had been summoned to record a statement and was later released on police bond as investigations into the matter continue. 

Bad Black is the third person to be investigated for offensive communication against the president in the last one year with the first being Dr Stella Nyanzi who is currently on remand at Luzira prison for vulgarly abusing the president's late mother Esteri Kokundeka in a poem published on social media.

The second was Susan Namata, a 21 year-old woman who allegedly used social media and threatened to hit the president with her genitals. She has since been released on bail.

Gen Kyaligonza's guards arrested for assaulting a traffic officer

Two Military Police Unit bodyguards for Uganda's ambassador to Burundi (Rtd) Maj Gen Matayo Kyaligonza have been arrested for allegedly assaulting a traffic officer on duty.

Lance Corporal Peter Bushindiki and Private Okurut John Robert, who were both deployed as Very Important Persons (VIP) guards for Kyaligonza were captured on camera assaulting a traffic officer Sergeant Esther Namaganda who had stopped them from making a u-turn in the middle of the road.
 
The incident whose video recording went viral on social media, occurred yesterday in Seeta, Mukono district. Namaganda filed a complaint at Seeta police station.
 
According to the complaint, Namaganda alleges that the driver of the vehicle in which Kyaligonza was moving, tried to make a u-turn in the middle of the road. However, the two military police officer and Kyaligonza pounced on her when she tried to direct them to the right turning point. 

Uganda People's Defence Forces (UPDF) spokesperson Brig Gen Richard Karemire says that the two soldiers were arrested as investigations into the incident continue. 
 
"They are now held at Military Police Headquarters. We reiterate our commitment to ensuring discipline of all ranks," Karemire said.
 
Karemire said according to preliminary evidence so far obtained, Kyaligonza did not take part in the assault and hence no case file has been opened up against him. Also assaulted by Kyaligonza and his guards, was UBC TV sports journalist, Peter Otai who took pictures of the incident. According to Otai, Okurut even attempted to stab him with a sword but missed him narrowly.

First plane for revived Uganda Airlines arrives next month

The first aircraft for the the revived Uganda Airlines is expected to arrive in the country in a month's time. 
 
The minister for Works and Transport, Monica Azuba Ntege says that the pilots of the Bombardier CRJ900 jet were sent to Canada for training. Azuba said they are supposed to meet with manufacturers to iron out a few issues and set date when the first jet will be delivered. 

The Bombardier CRJ-900 hit the skies for the first test flight at Montreal Mirabel international airport, Canada last week. An 8-minute video clip was uploaded on YouTube on Sunday showing the test flight. The video clip triggered excitement from Ugandans.

"That was the first flight test and they are still doing more test flights," Azuba said. "It due to come this month or next month. We are having a meeting which will set the date when we will receive it. So anytime within a month, it will be here."

Last year, Uganda ordered for four CRJ900 regional jets as part of the much-anticipated plan for the revival of Uganda Airlines. The revived airline will be the first carrier to operate the new CRJ-series atmosphere cabin in Africa. Atmosphere cabin design allows passengers to carry and store an "oversized" roller bag within the aircraft cabin bins which minimizes the need to check bags at the counter or the gate. 
 
The airline will operate the CRJ900 in dual-class configuration with 76 economy seats and 12 first class seats. According to the manufacturer, the new model atmosphere cabin sets new standards of passenger experience in the regional jet market segment. Key features of the new interior comprise of larger passenger living space, wheel-first roller bag capability, more spacious lavatory, increased cabin connectivity options, all integrated into a contemporary design and material choices. 

The first Bombardier was supposed to be delivered last month. But there were changes in the programme. The initial plan was that the manufacturer would be delivering a jet per month starting January. This arrangement will be followed after delivery of the first aircraft.

MTN questions reason for CEO deportation

MTN Uganda has appointed Gordian Kyomukama, the telecom's chief technology office as the acting chief executive of the company following the deportation of the substantive chief executive officer Wim Vanhelleputte yesterday. 
 
The Belgian was deported last night, on the orders of the Internal Affairs minister, Gen Jeje Odongo making him the fourth employee of the company to be a prohibited immigrant declared under section 52 (g) of the Uganda Citizenship and Immigration Control Act.
The section among others, stipulates that a person shall be declared a prohibited immigrant as a consequence of information received from reliable sources and confirmed by the minister or by the commissioner to be an undesirable immigrant.
 
Vanhelleputte is the fourth MTN Uganda top official to be declared persona non-grata in a space of just one month. The others are Italian Elsa Mussolini, the former general manager for mobile finance services, French national Olivier Prentout, who was the chief marketing officer at MTN Uganda and Rwandan national Annie Bilenge Tabura, the general manager sales and distribution.
 
But security agencies have not come out to explain what exactly the case is against the deported foreigners. However, according to sources within the security circles, security agencies have been investigating a number of foreign nationals over their engagement in acts that compromise national security. The investigations that have since been labelled classified are still ongoing under the leadership of the deputy inspector general of police Stephen Sabiiti Muzeeyi.
 
"We are understandably concerned about these developments and are engaging with the authorities to seek understanding that would lead us to resolve this matter," the telecom giant posted on its official Twitter handle this morning. It added that MTN Uganda is fully committed to respecting and operating within the laws of the country.

1966-2019: How Ocheng motion brought the gun in Uganda’s politics

For at least 33 years, February 6 is celebrated annually. General Museveni's emphasis on military capability connects Tarehe Sita to another historical event, 53 years ago, that might be a major factor in the militarisation of Uganda's politics. In the second and final part of our series, we revisit some of the events of 1966 that laid the foundation for successive leaders to always turn to the military to answer questions of political nature.

Foreign Affairs minister Sam Odaka and John Kakonge, a specially elected legislator, tried in vain to turn the political tide. In the end, only Kakonge opposed the motion. As the motion sailed through parliament and Amin was sent on leave, Prime Minister Obote returned to Kampala. 

Odaka's Creed

Sam Odaka, Foreign Affairs minister and member of parliament from Tororo, began his submission by hitting at some of his cabinet colleagues whom he accused of treachery. He coined what he called "Odaka's creed."

"I believe in government, and in its being quite decent, condoning no corruption, condoning on criminal acts, carrying out its full duties and responsibilities, collectively and justly. I believe that ministers who find the cabinet motto, "One for All and All for One" unacceptable to them, must resign at once from it."
 
Odaka was directing his "creed" at ministers Balaki Kirya, Emmanuel Lumu, Mathias Ngobi, Grace Ibingira and George Magezi. This forced Dr Lumu to respond: "Many members of this House asked us to resign quickly, from the Uganda cabinet…Why should we? What is wrong with this motion? It has not censured the Premier, it censured not cabinet, it gives none of you a cause to call for the resignations of some of your ministers who resolved to accept it."
 
But Odaka had turned his gun and pointed it to the mover of the motion, Daudi Ocheng. "Ocheng has accused so far seven outstanding persons of the crime of corruption. These are minister Lumu and minister Ngobi, Mr Roger Mukasa, chairman of the Coffee Board, and Kalangi Ntende, chairman of Lint Marketing. And, today, the Prime Minister and two of his ministers."

Odaka argued that Ocheng's allegations were not backed by any written complaints nor by any affidavits, noting: "Corruption exposure is now Ocheng's speciality. I do not grudge him the job, but I would like to ensure that he does that good job well by following simple rules and elementary steps of reporting any crimes. The machinery is here, why then does he not use it? Is he afraid …that a libel case would be brought against him?"
 
Odaka chided Ocheng for using parliamentary immunity to destroy other people's characters. "He prefers parliamentary freedom and immunity to protect him from his trade - trade of assassinating character, and all good names," Odaka said.
 
Summing up his submission, Odaka said: "Go ahead Mr Ocheng. Ply well this tough trade of yours, your target is now in sight. Charge a few more ministers of corruption and bribery, and most ministers would be corrupt according to you. That would be the very time to change government at once…"
 
Odaka was a strong UPC pillar and confidant of Obote in the 1960s and 1980s. As foreign affairs minister from 1962 and 1971, Odaka played a leading role in organising the visit of Pope Paul VI to Uganda in July 1969, the first papal visit in Africa. As Mutesa lived on handouts in exile from 1966 until his death in 1969, Odaka was the face and voice of the Obote I government as it took a hard-line stance, denying the Kabaka access to financial resources.
 
Later, in the Obote II government between 1981 and 1985, Odaka served as Planning and Economic Development minister until Obote's overthrow in July 1985. He died in August 2015.
 
Country going to the dogs, heading for trouble
 
John Kakonge, the only legislator to unequivocally oppose the motion, had lost his secretary general's docket to Ibingira at the 1964 UPC delegates conference in Gulu. Ironically, Obote had outmanoeuvred Kakonge in support of Ibingira during the conference. In 1965, Kakonge became a specially elected member of parliament, this time with the backing of Obote and with Ibingira opposing him.
 
During the debate, Kakonge called on his colleagues to have clarity of mind. "Clarity of mind is what we need most right now. Though the motion charged Amin of alleged grave misconduct…the mover charged the premier and two of his ministers of corruption and of plots to overthrow, by violence, the Uganda constitution," Kakonge submitted.
 
He added: "What does this really entail? Might acceptance of motion not imply that this very House has accepted accusations against our premier and two of his ministers?"
 
He cited what he called abnormal behaviours, unusual practice and the strange things going around as causes for concern. "Thus for the first time this House has seen ministers clash here. It has seen ministers talk and reveal what they should not. Judging by the trend of these unusual occurrences, we are going to the dogs, we are heading for trouble," warned Kakonge,
 
Opolot, not Amin bringing trouble
 
Kakonge accused Army commander, Brigadier Shaban Opolot, not his deputy Col Idi Amin, of plotting to topple the government. "Punishing Col Amin will not solve any trouble. I have heard other versions of what is to bring trouble. It is not Col Amin but Brigadier Opolot, commander of the army," he said.
 
He added that a group of ministers were supporting Opolot and that they regarded Amin as a stumbling block. Kakonge went on to downgrade the debate as of the lowest standard characterized by rumours, hearsay and falsehoods. Just like Sam Odaka, Kakonge warned of trouble ahead unless government took firm steps to arrest the situation.

"I can see with my mind's eyes; troubles knocking at the door, and tragedies threatening to swallow all of us up…Only one thing can save us: firm and very firm action by the Uganda government, to whom I now say this much: Stop these plots and counter-plots."
 
Without mentioning names, Kakonge warned of foreign elements working with local leaders to undermine the government. "Mark my words about these plots, they are not of native birth but born and bred by aliens, executed by some of us who rather unwittingly got involved with those aliens. It might yet not be too late, for them to defy aliens," he said.
 
He asked those involved in plots and counter-plots to reflect on the repercussions of their actions. "It will sober you a bit: if we have disturbances, we have a civil war, all of us will be involved; none might escape its consequences. Any life which may be lost, any property destroyed might be yours, or might be mine. Nothing should, therefore, stop us from working as a unit, for our preservation; for safety of property and the welfare of this dear land," Akena Adoko quotes Kakonge on page 53 of his book, The Uganda Crisis.
 
Do you think at all?
 
Kakonge called for dialogue to address the issues at hand. He posed reflective questions to the House: "Must we wash dirty linen publicly and outrageously? Must we shout all our sins from roof-top to roof-top? Can't we sit round a table and discuss things responsibly? Do you members think at all? Do you think before you speak? Can you weigh the great damage that has been done to this land by your thoughtless utterances of corruption and a coup by our prime minister? Do you know the motivation for Ocheng's accusations against our premier? We will have no unity when we do not show respect due to …our national leaders."
 
Pyrrhic victory
 
To Kakonge, Ocheng himself did not believe in his own allegations that he wanted to convince parliament to believe. He warned those who saw victory in Ocheng's motion that it was victory with no winner. "Some of us cannot see it, they take it as victory. True it is a victory, but a pyrrhic victory: for one more such victory and Uganda will be lost. It's a pyrrhic victory which teaches us one lesson: we swim or sink together. Mr speaker, I do beg to oppose the whole motion," Kakonge summed up his submission.
 
With Kakonge the only dissenting voice, parliament passed the motion suspending Amin and directing an inquiry into his bank account. The following day, on February 5, Defence minister Felix Onama sent Amin on a short leave, not on suspension. But things moved very fast.
 
Phares Mutibwa, in his 1992 book, Uganda since Independence: a story of unfulfilled hopes, says Ibingira, with backing from Sir Edward Mutesa, was pushing for the control of the ruling party, and later, the government.

On page 38, Mutibwa captures it thus: "The political dispute between Obote and Ibingira and his supporters centered around the control of UPC and ultimately the very leadership of the country in terms of the political and economic ideologies that were to be followed."

While Obote preached socialism and rallied his government to "move to the left", Ibingira was a capitalist. With neither harmony in the ruling party, nor in government, Obote returned from his long tour of northern Uganda, on February 12, to take charge.

In his 1968 article, Obote says the situation compelled him to take what he called drastic actions. On February 22, 1966, some 18 days after the Ocheng motion in parliament, five cabinet ministers were arrested during a cabinet meeting. The five included Grace Ibingira, Dr Emmanuel Lumu, Balaki Kirya, Mathias Ngobi and George Magezi.
 
Akena Adoko, who at the time headed the General Service Unit, a Uganda government internal and external security agency, quotes Ibingira after his arrest: "Fate is a double-crosser. I was the very person who saved from being repealed, the deportation ordinance."

Opposition legislators had introduced a motion, in late 1965, seeking to repeal a colonial era law that gave government powers to detain suspects without trial. Ibingira convinced parliament not to repeal it.
 
Two days after the arrests, the 1962 Constitution had been put aside, replaced with an interim one that dismissed Sir Edward Mutesa as President of Uganda and Sir Wilberforce Nadiope as vice president. The same Constitution made Obote executive president. Obote addressed the press thus: "Recently, attempts were made to remove my government by the use of foreign troops…To safeguard our sovereignty, we must take counter measures: suspending the Constitution, and hence posts of president and that of vice president."
 
By the end of May 1966, Sir Edward Mutesa was in exile, his palace lying in ruin after a military raid under the command of Amin, who had by now been elevated to head the army. Mutesa would die three years on November 21, 1969, two days after celebrating his 45th birthday. From then on, Uganda's political problems would be solved by military means.

Brigadier Opolot was already serving time in Luzira prison, only to be released in January 1971, by Amin. Ocheng, the man whose motion started it all, died suddenly on June 1, 1966, aged 41 years. In his 2018 autobiography, Dr Martin Aliker, a veteran dentist, politician and businessman explained that Ocheng was diagnosed with cancer of the stomach shortly before he died.

Ocheng was Aliker's elder brother. His death came just eight days after the attack on, and exiling of, Sir Edward Mutesa, his closest friend and 99 days after the February 4 motion. He may not have lived for 100 years as he wished, but 53 years after the motion, its effects are still visible.
 
Meanwhile more promotions would come Amin's way, to Brigadier by 1969 and to Major-General by January 1971 when, using the army, he turned against Obote and overthrew him.
 
A young man named Yoweri Museveni watched these developments keenly as a secondary school student in Mbarara district. He would write later, in his book "Sowing the Mustard Seed", that he and fellow students began asking themselves questions about the future of Uganda. After graduating from university in Tanzania in 1970, he secured a job in President Obote's office just months before Amin's coup.

Obote had lost power through the only means he thought he had total control over - the military. The young Museveni was, meanwhile, thinking about fighting the new president.

"Amin took power on January 25, 1971 and two days later, on January 27, I had left the country to go and prepare to fight him," Museveni told a conference of judges last week, 48 years after Amin's coup and 33 years after Museveni's own military take-over of government.
 
By the end of 1978, Ugandans living in exile had forced their way back with the military support of Tanzania. General Idi Amin would be pushed out of power in April 1979.
 
The rigged elections in December 1980 that forced Museveni to pick up arms on February 6, 1981 were meant to restore order and dialogue after the brutal years of Amin's rule.

Whenever dialogue has failed to address political questions of the day, there's been recourse to the gun, from 1966 to 1971, 1979, and 1981 and beyond. President Museveni has been a student of, and then a participant in, this cycle of violence; the reason he said emphasised the UPDF capacity to defeat "whoever thinks of destabilising Uganda" on February 6, 2019.

Immigration accused of charging tourists illegal visa fees

The police's directorate of criminal investigations (CID) has opened investigations into officials of the ministry of Internal Affairs, directorate of Citizenship and Immigration Control for allegedly defrauding tourists entering into the country.

The investigations were ordered by the minister of Internal Affairs, Gen Jeje Odongo following increased complaints by foreigners that they were being charged exorbitant fees for visas.

According to the investigating officers, more than 200 foreigners have filed complaints to the ministry after realising that they paid two to three times the cost of a visa.

For instance, while a tourist visa costs only Shs 190,000, investigations revealed that the officials were charging Shs 560,000 per visa. A reliable source in police who spoke on condition of anonymity, says that a general enquiry file has since been opened.

"We have opened the file. We have complaints from the ministry but now we need the victims to come and record statements," the source said.

While Immigration acknowledges receiving complaints about the illegal visa charges, the officials say the victims have been getting the visas through informal channels. The acting director Citizenship and Immigration, Marcelino Bwesigye says the tourists need to be warned of existing scam sites which charge exorbitant fees or defraud them.

Bwesigye said the official website is, www.visa.immigration.go.ug through which all types of visas to Uganda, work permits, certificates of permanent residence, student passes and dependants' passes at an official fee can be acquired. Bwesigye said visa processing usually takes up to three working days and that there is no extra cost for fast tracking visas.

He advised foreigners seeking visas to use the official to use the official web site and any e-visa applications.

"People visiting Uganda can apply no matter from where you are from and should not be confused as a platform for renewing passports. It's only for foreigners who want to visit Uganda and require a visa" said Bwesigye.

BOU tasked to explain dollar payments to local lawyers

Bank of Uganda has been tasked by MPs to explain why external lawyers were paid in foreign currency despite filing their invoices in Uganda shillings. 

The lawyers from MMAKS Advocates were paid $230,000, which translated into Shs 759 million at the 2017 exchange rate, for services relating to the transactions by the central bank in the closure and sale of Crane bank to dfcu bank. The law firm is run by city lawyers; Apollo Makubuya, Timothy Kanyerezi Masembe, Moses Adriko, Mathias Ssekatawa, Ernest Ssembatya and Isaac Walukagga.

Part of the money, amounting to $93,872 (about Shs 346m), was the bill computed on services offered on an hourly basis. According to one of the legal firm's partners, Timothy Masembe Kanyerezi, the bill was based on a blended partner/associate rate of $217 (about Shs 800,000) per hour.

The rest of the bill, totalling $136,128 (Shs 500m) was payment for drawing and negotiating the terms of the purchase of assets and assumptions of liabilities agreement. It was based on the Shs 200 billion cash consideration for Crane bank assessed at a discounted rate of 0.24 per cent.

Yesterday, the parliamentary committee on Commissions, Statutory Authorities and State Enterprises (Cosase) probing into the irregular sale of commercial banks tasked the central bank team led by governor Emmanuel Tumusiime-Mutebile to explain why the payment was made in a foreign currency. The legislators accused Bank of Uganda of showing no confidence in Uganda's currency on top of advancing payments without evidence for work done.

Aruu North MP Odonga Otto tasked deputy governor Louis Kasekende who approved the money for Crane bank liquidity support to provide the legal instrument he used to authorize the payments. He also demanded for minutes of the meeting justifying the amount paid out.

Mbarara Municipality MP Michael Tusiime said that the payment was in contravention of a guideline by the permanent secretary and secretary to treasury (PSST) Keith Muhakanizi; warning all accounting officers against paying contractors in foreign currencies, save for contracts that were running before the time of the directive issued in 2016.
 
"I see this interventional cost of $1.6m paid part of it to local suppliers including MMAKS in dollars against the authority of PSST in reference to Section 79 of the Public Finance and Management Act of 2015. For me, these approvals before we go to the amounts, am still interested in the authority of approvals especially those approvals in foreign currencies." said Tusiime. 
 
Tusiime insisted that Kasekende explains why local contractors were paid in foreign currency despite a ban from the Treasury. Kasekende denied approving the payment in dollars but added that the cited letter by Muhakanizi was addressed to accounting officers in local governments.
 
"This is a very specific issue, I don't think I'm even the one who approved it. Let the officials explain that process and the approval process for that amount." said Kasekende. 

Cosase vice chairperson Anita Among and Abraham Byandala, one of the committee members questioned whether the central bank makes its budgets in local currencies or foreign currency, to which Kasekende said that their budget is drafted in the local currency. 

"I was even yesterday wondering why Bank of Uganda pays in dollars. Are you doing this because you anticipate economic dislocation or what? Do you prefer paying in dollars even where it is not necessary because you anticipate economic discretion? Because in the case of these lawyers surely where will the economic dislocation come into." said Byandala. 
 
Yusufu Mukiibi, the BoU acting chief accountant said that the money paid out to the lawyers in US dollars was a commission to lawyers who recovered money from Crane bank shareholders from the foreign reserves. He said that their office acts on approved instructions from management.
 
The Committee directed the Bank of Uganda to provide a written response to the issue.

Now Nawangwe wants School of Law closed indefinitely

Makerere University vice chancellor, Prof Barnabas Nawangwe has recommended for the indefinite closure of the School of Law for failure to resume teaching.

The recommendation is contained in a 7-page report dated February 11 addressed to Lorna Magara, the chairperson of Makerere University Council. Nawangwe's recommendation follows the university council's directive to management during its 145th meeting held at Speke Resort Munyonyo on February 8.

The council had directed that the vice chancellor and management of the university to expeditiously handle matters pertaining teaching of students, research and community outreach.

It had also directed the university management to provide a status report clearly indicating the actions taken to resolve the impasse. According to a copy of the report, Prof Nawangwe observes that in spite of the on-going engagements, the standoff has remained predominant in the School of Law where the school leadership has "openly declared leadership of the acts of defiance."

Prof Nawangwe attaches a copy of the second legal opinion of the School of Law signed by the Principal Associate Prof Christopher Mbazira in which they stood their ground that the vice chancellor Prof Barnabas Nawangwe has no powers to suspend staff or appoint a committee to investigate employees. Nawangwe's suspension of the academic staff association leaders triggered off a staff strike now into a fourth week. 

Nawangwe contends that given the position taken by the School of Law to defy authority and incite the rest of the university to follow their bad example, it is recommended that the School of Law be closed indefinitely.

"The staff should be required to hand over university property and the students advised to return home and await further instructions," Nawangwe says in a management report to council.

"Armed with misleading advice by some staff of the School of Law, executives of staff associations want an unconditional lifting of the suspension of Dr Deus K Muhwezi as a condition for calling the general assembly to lift the purported strike," Nawangwe notes.

He further alleges that the students were being mobilized by the executives of staff associations to join them and put pressure on management to unconditionally reinstate Dr Deus K. Muhwezi. But insists that; "management will follow the laid down procedures and the students have shunned these calls."

According to Nawangwe, the institution and management, on the other hand, maintains, that such an action would set a very bad precedent of impunity.

"It would be possible in future for someone to do wrong but just because they can mobilise others, no disciplinary action would be taken. This would greatly undermine disciplinary powers of Management as well as set a wrong future precedence," Nawangwe argues.

He adds that unconditional lifting of a suspension is also not provided for in the human resources manual of the university and is thus illegal and unlawful. He also observes that the perpetrators of the stand-off want to create a an ungovernable situation at the University.

Further, Nawangwe says all colleges have since resumed full teaching including College of Engineering, Design Art and Technology (CEDAT), College of Health Sciences (CHS), College of Veterinary Medicine, Animal Resources & Biosecurity (COVAB), College of Education and External Studies (CEES), College of Natural Sciences (CONAS), College of Humanities and Social Sciences (CHUSS), College of Business and Management Sciences (COBAMS), College of Computing and Information Sciences (COCIS) with partial teaching in College of Agricultural and Environmental Sciences (CAES), with the exception of the School of Law where no teaching has been reported.

URN has however established that more than 200 staff of CAES have unanimously agreed to withdraw labour in support of the joint associations resolutions. Additionally, Prof Nawangwe's report that all colleges are teaching except CAES and Law School is being contested by Makerere Law Society (MLS) who say it is false.

"The record must be set straight. Makerere University has ten colleges. Of these, only two colleges (College of Health Sciences and the College of Engineering Art & Design) are presently having lectures and this fact is confirmed by the student leaders of the different college student leadership that have hereunder appended their confirmatory signatures," MLS said in a statement released yesterday afternoon.

They further add that; "The representation by the university administration, that lectures are on-going within the entire university save for School of Law is patently false and borders on being divisive. Furthermore, the claim that students are the ones voluntarily boycotting class is equally false."

But according to Nawangwe; "The continued defiance by the School of Law, meaning that the students will not be taught for a fourth week running is likely to lead to a deterioration of discipline among the students with unforeseen consequences."

Some of the law dons who preferred anonymity said that they had not received the report.

"But if that is the recommendation, then this would be the worst decision for council to make. We have only given a legal opinion. And by the way, most of us here at Law School are not here for the job. No! We are here simply because we feel we want to make a contribution to jurisprudence," a Professor of law said.

Before adding that; "Don't be surprised, in case such a decision is made, even if they close the school for one month, I am sure 50% of us would not return. We can't work in a lawless institution."

In a related development, two principals, Prof Christopher Mbazira of Law School and Prof Bernard Bashaasha, the Principal of CAES have been summoned to council to explain why they are not teaching.

Bank official held over theft of Shs 130m Nyakasura alumni money

Wandegeya police station is holding in custody the Nyakasura Alumni Association treasurer for allegedly using his position in the dfcu bank to steal over Shs 133 million from the association's accounts held in three banks.

Suspect Faisal Bahati, who was recently fired from dfcu bank has been in custody since February 1 and is alleged to have forged signatures and used them to withdraw money from the three different accounts in dfcu bank, Centenary bank and Equity bank. The bank accounts under the name; Nyakasura Renovation are: 3201669577 in Centenary bank, 01011114623702 in dfcu bank, and 1001201067509 in Equity bank.
 
The case was reported at Wandegeya police earlier this month by the members of the Nyakasura School Alumni Association, a group for which Bahati has been the treasurer and also one of the three signatories to the Renovation accounts.
The association brings together former students of Nyakasura School, located in Kabarole district. Last week, dfcu put a notice in the newspapers indicating that Bahati and two other staff, Philbert Aijuka and Saidi Ddamulira were no longer employees of the bank.
 
"This is to notify the public that the above named persons ceased being employees of dfcu bank limited. They are not authorised to transact any business on behalf of dfcu limited," read the statement which also carried the photographs of the three people.
 
It is not clear if Aijuka and Ddamulira are also part of the fraud. Jude Kansiime, the head of marketing and communication at the bank did not return our repeated calls. According to statements recorded by the association members, a few weeks ago they realised that money amounting to Shs 98 million was missing from their dfcu bank account and Shs 30 million from the Centenary bank account. Another Shs 5.1 million was missing from the Equity bank account. The total amount defrauded is Shs 133.1 million.

The association members sought explanation from the three banks which produced documents showing that the money had been withdrawn with the consent of all signatories in different intervals and had been picked by the association treasurer.
 
According to the deputy Kampala Metropolitan Police spokesperson Luke Owoyesigyire, the suspect forged signatures of his colleagues and used them to withdraw the money while he was still working in dfcu and also after he had been sacked from the same bank.
 
"We have already started investigations and we are trying to trace for the stolen money. We highly suspect that he was not working alone in this scam," Owoyesigyire said.
 
The suspicion of not working alone is based on information that the other signatories to the accounts didn't receive any notification of the various withdraws that were effected by Bahati and yet it is the banks' procedure that for every transaction, an SMS notification is sent to the account holder or its signatories.
 
Bahati is currently being held on tentative charges of fraud, theft of money and conspiracy to defraud. In a telephone conversation, Frank Manyindo, the Nyakasura School headmaster, who is also a member of the school's alumni, said that the banks abdicated their responsibility to protect clients' money.
 
"It is the responsibility of the bank to protect clients' money. The money was stolen by their staff. The bank should refund it," Manyindo said.
 
Manyindo said the money had been collected from former students of the school to "for specific work which is not complete."  
 
Asked on what the alumni community has done to push the banks to have their money refunded, Manyindo referred URN to David Kihumuro, the chairperson of the alumni association. Kihumuro too said he was in a meeting and promised to call back.
 
David Kaija, the head of projects for the Nyakasura School Alumni, first declined to give details - saying he was in a meeting. He later called back, and revealed that the association has since engaged Bank of Uganda to have the money recovered.
 
Allen Ayebare, Centenary bank's chief manager corporate affairs and communication said she was out of office and referred URN to Michael Bulyerali from the communications department. Bulyerali said he didn't know about the case and promised to get back after consulting "about three divisions".  
 
Nyakasura School, a 93-year-old institution, was one of the powerhouses of education in Uganda, in the same league as Kings College Budo, Namilyango College, St Mary's College Kisubi, Gayaza High School, Ntare School and Busoga College Mwiri among others. Most of these traditional giants, however, fell into decline in performance over the last 20 years, a factor that could have forced the Nyakasura alumni to step in to restore the lost glory.
 
In 2017 the alumni embarked on a fundraising drive and up to Shs 165 million was realized in cash and pledges. In December, the alumni community renovated and restored the hydram water pump system at the school. The system, built in the 1940s, pumps water from a nearby river to Nyakasura School and the neighbouring communities. The group also embarked on renovation of dormitories at the school.

Makerere University staff maintain strike

Academic staff at Makerere University have rejected calls by university management asking them to return to work. The staff jointly vowed not to return to work unless their suspended leaders are reinstated.  

The resolution was made during a joint general assembly held on Monday afternoon at the Makerere Main Hall where staff unanimously demanded respect of their associations and leaders. 

A fully packed assembly was attended by staff belonging to the Makerere Administrative Staff Association (Masa), Makerere University Academic Staff Association (Muasa) and the support staff under the National Union of Education Institutions.
The meeting was also attended by members of university management, who, had on Friday last week constituted themselves into a meeting of "concerned staff" and called off a strike. 
 
Makerere staff went on strike at the start of the semester following the suspension of Bennet Magara and Joseph Kalema; both leaders of Masa and Dr Deus Kamunyu Muhwezi, the Muasa chairperson, for alleged misconduct and violation of the terms of their employment.
 
The staff demanded the immediate reinstatement of their colleagues, arguing that they were irregularly suspended. Prof John Jean Barya, a law don advised the members of staff not to resume work because similar scenarios, sometimes the negotiations can take even more than two years.  
 
"I want to give one simple advise. I want us to understand that we're in this situation because we're defending our own freedom to associate and to speak. Once we falter, you will never speak again." he said. 
 
Prof Edward Nector Mwavu, the Muasa vice chairperson speaking after the emergency general assembly said the staff want their staff leaders reinstated within three days before they can resume work.  

Diana Ahumuza from Law School urged staff colleagues not to return to work unless their association leaders are reinstated.  
 
"We are serious stakeholders, if we cannot fight for our rights, then what are we teaching students? At least let them reinstate the leaders then our leaders can be able to work on other resolutions. If they cannot do that, let us go home when they are done, we'll open the university and teach. Why should we be so anxious to teach? We're entitled to our salary whether we're teaching or not because industrial action is a constitutional right." Ahumuza said. 

During the assembly, the staff invited the vice chancellor Prof Barnabas Nawangwe who in his address to staff said he was ready to uphold dialogue and mutual respect for his colleagues in staff association. 

He appealed to staff to return to work saying that the institution was losing so much due to the strike. But his appeals were turned by staff who said they only want their leaders back.

King Oyo meets Museveni over Tooro assets

The king of Tooro kingdom Oyo Nyimba Kabamba Iguru Rukidi IV has met President Museveni over the return of the kingdom assets. The meeting took place yesterday, Thursday at State House Nakasero.

Oyo was accompanied by the Queen Mother Best Kemigisa and members of the Tooro kingdom negotiating team led by the kingdom prime minister Bernard Tungwako.

Tungwako says that visit was meant to remind the president about his pledge that he made in 2013 that the government would return the kingdom's assets. 

The assets including land, county and sub-county headquarters among others which were forcefully taken from kingdoms by the central government in 1966 when the then President Milton Obote abolished traditional institutions and made Uganda a republic.

The assets are located in Kabarole, Kamwenge, Kyenjojo and Kyegegwa districts. The kingdom also has assets in Kasese and Bundibugyo, which were formerly under Tooro Kingdom.

According to Tungwako, Oyo told the president that the delay by the government to return the properties has affected the kingdom financially. He said that if the assets are returned, the kingdom can rent them out and get income to sustain its activities and improve its financial base.

King Oyo also reportedly told Museveni that the kingdom and the government negotiating team are yet to agree whether the kingdom should be given royalties from Kilembe mines, Queen Elizabeth national park and Katwe salt lake in Kasese district, which are now under the Rwenzururu kingdom.

According to Tungwako, another meeting with the president has been scheduled in two months time. In 2014, youth from the kingdom walked more than 300 kilometres to Kampala protesting against the delay by the government to return the kingdom's assets. 

The youths under their umbrella group, Amacumu ne Bitara later delivered the petition to the speaker of parliament, Rebecca Kadaga. 

Kadaga pledged to work with members of parliament from Tooro to present a motion that will create a resolution for government and Tooro officials to start negotiations.
